WHAT HAPPENED STARTING FROM 25 MAY 2018?
From this date, Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), known as GDPR (General Data Protection Regulation), has been put into effect. This means that any Operator/Entity processing personal data must apply these new requirements and provide transparent information about how the data is processed.

WHY IS MY DATA BEING PROCESSED?
Given the need to comply with the GDPR provisions, and the fact that we are dedicated to caring for your personal data (which may include first name, surname, e-mail address, etc. depending on the purpose of processing) held in our database, we inform you that this data is used only for the successful completion of processes carried out in our relationship with you (a few processes, without limitation: BILLING, QUOTING, DELIVERY, SERVICE PROVISION, CUSTOMER SUPPORT SERVICE, RECRUITMENT).

0. INTRO:
Starting from 25 May 2018, Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the „GDPR Regulation”, applies. Please consult the information in this document as it sets out the policy of PROFAL INDUSTRY S.R.L. regarding the processing of personal data. Within PROFAL INDUSTRY S.R.L. we process personal data exclusively within the legal provisions on personal data protection.

DEFINITIONS:
Operator = Operatorul responsabil pentru prelucrarea datelor in sensul Regulamentului GDPR este ROHEL TRANS INTERNATIONAL S.R.L., firma cu capital privat, inmatriculata la Registrul Comertului cu Nr. J23/1783/2005 , cod fiscal RO 16291216, sediul social in Sat Betesti nr. 10, localitatea Cristuru Secuiesc, judet Harghita
, denumit in continuare „Operatorul” sau „ROHEL TRANS INTERNATIONAL”.

Cookies = Un „cookie” este un fisier de mici dimensiuni, format de regula din litere si cifre. Acesta este descarcat in memoria unui calculator sau a altui tip de dispozitiv folosit pentru navigarea pe internet (smartphone, tableta, etc), atunci cand utilizatorul acceseaza un anumit site web.
Data subject within the meaning of the GDPR Regulation = an identified or identifiable natural person (who can be identified, directly or indirectly, in particular by reference to an identifier: name, identification number, location data, an online identifier or one or several specific elements of their physical, physiological, genetic, mental, economic, cultural or social identity). The data subject may be the applicant for a service offered by the Operator, as well as any other natural person whose personal data is transmitted to the Operator (for example, a client or potential client, a candidate for an available position, a user of the Operator’s website, etc.).

Categorii de date prelucrate = Datele cu caracter personal (prenumele, numele, data nasterii, adresa, nr. de telefon si adresa de e-mail etc.) sunt prelucrate de catre noi doar in situatia in care introduceti aceste date intr-o rubrica de pe site sau ni le transmiteti prin e-mail.
Personal data processing = any operation or set of operations performed on personal data or on sets of personal data, with or without the use of automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

1. THE PURPOSES AND LEGAL BASIS FOR PROCESSING YOUR DATA:
Conform Regulamentului (UE) 2016/679 si a legislatiei conexe, scopurile pentru care prelucram datele dumneavoastra personale vizeaza strict relatia dintre ROHEL TRANS INTERNATIONAL Si persoana vizata. Informatiile pe care ni le furnizati sunt tratate cu maxima confidentialitate si exclusiv in scopurile pentru care au fost colectate.

1.1. CONCLUDING AND MANAGING THE RELATIONSHIP WITH CLIENTS:
a. Accesarea site-ului:
La fiecare accesare de catre un utilizator a unei pagini din oferta noastra si la fiecare deschidere a unui fisier, datele de acces sunt salvate de catre noi si partial de catre terti sub forma unor fisiere de tip protocol. Fiecare set de date cuprinde: pagina de internet de pe care accesati pagina noastra, adresa IP, data si ora accesului, solicitarea clientului, codul de raspuns http, cantitatea de date transferata, informatii despre programul de navigare si sistemul de operare folosit de dumneavoastra.
b. Date obtinute dupa trimiterea unei cereri de oferta: In momentul transmiterii unei cereri de oferta, datele dumneavoastra vor fi salvate in baza de date a companiei ROHEL TRANS INTERNATIONAL. Aveti posibilitatea de a solicita oricand stergerea datelor dumneavoastra si a contului dumneavoastra de client. In cazul in care plasati o cerere de oferta pe site-ul nostru, datele vor fi prelucrate in scopul desfasurarii cu succes a procesului de vanzare. e. Date pentru plasarea unei comenzi:
The stored personal data will be used for the purpose of carrying out contracts and processing your requests. After the contract or your request has been completed, your data is retained taking into account the retention periods under tax and commercial legislation and, where applicable, for a duration necessary to protect the Operator’s rights.

LEGAL BASIS: the legitimate interest of the Operator in preventing online fraud and ensuring the general functionality of the site, contract performance and the consent of the data subject, as applicable.

PROCESSING PERIOD: ROHEL TRANS INTERNATIONAL S.R.L. va detine si prelucra datele cu caracter personal pe o perioada de 6 (sase) ani. Aceste date vor fi prelucrate de catre societatea ROHEL TRANS INTERNATIONAL S.R.L. sau de catre prestatorii de servicii contractati de ROHEL TRANS INTERNATIONAL SRL (avocati, consultanti, auditori, institutii de credit, societati de arhivare/stocare documente, societati care imprima, administreaza si sau transmit facturi/deconturi/notificari, societati de prelucare a datelor, curieri, agentii de sondare a clientilor etc) in scopul imbunatatirii activitatii comerciale si de vanzari.

1.3. BUSINESS ADMINISTRATION: COOKIE POLICY

2.1. DREPTURILE PERSOANEI VIZATE SI CUM POT FI EXERCITATE
Potrivit Regulamentului GDPR, in calitate de persoana vizata beneficiati de un cumul de drepturi, respectiv:
a. Dreptul la informare si acces la date cu caracter personal: dreptul de a obtine o confirmare a faptului ca se prelucreaza sau nu date cu caracter personal care va privesc si, in caz afirmativ, acces la datele respective.
b. Dreptul la rectificare: dreptul de a solicita Operatorului si de a obtine, fara intarzieri nejustificate, rectificarea datelor cu caracter personal inexacte care va privesc si/sau de a obtine completarea datelor cu caracter personal care sunt incomplete, cu mentiunea ca in cazul unui cont online aceste modificari le puteti efectua personal din sectiunea de editare a datelor contului.
c. Dreptul la stergerea datelor („dreptul de a fi uitat”): dreptul de a obtine stergerea datelor cu caracter personal care va privesc, fara intarzieri nejustificate, in cazul in care se aplica anumite motive mentionate in Regulamentul GDPR.
d. Dreptul la restrictionarea prelucrarii: dreptul de a obtine restrictionarea prelucrarii in anumite cazuri.
e. Dreptul la portabilitatea datelor: dreptul de a primi datele cu caracter personal care va privesc si de a le transmite catre un al operator.
f. Dreptul la opozitie: dreptul de a va opune in orice moment prelucrarii datelor cu caracter personal care va privesc, in conditiile Regulamentului GDPR.
g. Dreptul de a nu face obiectul unei decizii bazate exclusiv pe prelucrarea automata, inclusiv crearea de profiluri, care produce efecte juridice care va privesc sau va afecteaza in mod similar intr-o masura semnificativa.
h. The right to lodge a complaint with the National Supervisory Authority for Personal Data Processing (ANSPDCP) if you consider that your data has not been processed in accordance with legal provisions.

How can you exercise these rights?

How long does it take us to respond to your requests? Within a maximum of one month from receipt of your request, you will be provided with information on the actions taken or, where applicable, on the reasons why the requested measures cannot be taken.

Note: Please note that in order to comply with a request for access to personal data, we will take all reasonable measures to verify the identity of the data subject.

3. THE RECIPIENTS OR CATEGORIES OF RECIPIENTS OF THE PERSONAL DATA:
Recipients who process personal data within the European Union are obliged to comply with the same legal provisions, offering the same level of protection as the Operator.

3.3. TRANSFER TO PUBLIC INSTITUTIONS, COURTS OF LAW AND COMPETENT AUTHORITIES FOR THE INVESTIGATION OF CRIMINAL OFFENCES In special cases, where required by law, PROFAL INDUSTRY S.R.L. may provide competent institutions with information regarding personal data. 3.4. TRANSFER TO OTHER THIRD PARTIES In order to offer you the most pleasant online experience, we are constantly concerned with improving and maintaining the software programs we use. To this end, we have concluded development contracts with companies specialised in software programming and maintenance.
